In compliance with article 10 of Spanish Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce, we inform you that the service provider is Panacea iv, with registered address at C/ Fernández de la Hoz 48, 28010 Madrid, Spain.

Purpose

These Terms of Use (hereinafter the Terms) govern access to, browsing of and use of the website (hereinafter the Site, Website or Web) as well as other customer communication channels (voice interfaces, etc.) of Panacea iv. Accessing, browsing and/or using the Site implies acceptance of all the provisions set out in these Terms, as well as of the Privacy and Data Protection Policy.

There are, however, certain services and content accessible through the Website that are subject to specific terms which may replace and/or supplement these Terms.

User status

User means any person who accesses, browses and uses the Website, its services and/or the content hosted on it.

Browsing, accessing and using the Website do not require prior registration. However, certain services offered through it are necessarily subject to registration and acceptance of the specific terms governing that service.

Access to the Website by minors is deemed to be expressly authorised by their parents, guardians or legal representatives, who are liable for the acts carried out by minors as Users of the Website in accordance with applicable legislation.

Requirements for use

Accessing the Site and the services offered requires a device meeting the applicable hardware and software compatibility requirements (which may change over time) and an internet connection. The User acknowledges that these factors may affect the performance of the Website and/or the ability to access the services offered.

Panacea iv is not responsible for the inability to access, or for deficiencies in the operation of, the Website and/or the services offered through it caused by the use of unsuitable devices, or by internet service interruptions arising from network congestion or any other cause.

Rules of use

Use of the service: the User undertakes at all times to use the Site and its services diligently, correctly and lawfully, in accordance with the law, this Legal Notice, these Terms (and/or those applicable in each specific case), the rules of use and instructions communicated to them, as well as with generally accepted standards of morality, good conduct and public order.

To that end, the User shall refrain from carrying out any unlawful or prohibited activity, or any activity harmful to the rights and interests of third parties, or which in any way may damage, disable, overload, impair or prevent the normal use of the services, the computer equipment, or the documents, files and any kind of content stored on any computer equipment belonging to Panacea iv, to other users or to any internet user (hardware and software).

Access control: the User may only access those information system resources for which they are authorised.

Temporary files: information stored on the Website must be consulted on the systems of Panacea iv, which shall under no circumstances be held responsible for information the User exports from those systems.

Conditions of use: when using the Website, the User is responsible for ensuring that the information they handle cannot be seen by unauthorised persons.

The User expressly undertakes not to store, use, transmit or distribute:

• Cracks, software serial numbers or any other content that infringes third-party intellectual property rights.
• Viruses distributed over the internet, worms, trojans or any other destructive activity, such as flooding, mailbombing or denial-of-service attacks.
• Activities that interrupt or interfere with other people's effective use of network resources.
• The collection and/or use of other users’ personal data without their express consent or in breach of data protection legislation.
• Sharing the access credentials provided (where the User is registered for a service that requires them) with any other natural or legal person.
• Destroying, altering, disabling or otherwise damaging the data, programs or electronic documents of Panacea iv or of third parties.
• Obstructing other users’ access through the massive and unjustified consumption of the computing resources through which Panacea iv provides any of its services, as well as performing actions that damage, interrupt or cause errors in those systems.
• Using the system to attempt to access restricted areas of the server without due authorisation from Panacea iv.

Intellectual and industrial property

The design, images, signage, distinctive signs, trade name, trademarks, logos, products and services contained on the Website are protected by industrial property law and are owned by Panacea iv. Use of, or access to, the Website and/or the services provided on it does not grant the User any right over that design, images, signage, distinctive signs, trade name, trademarks, logos, products or services.

Likewise, the Website, its source code and the content accessed through this site are the intellectual property of Panacea iv and/or of third parties, and may not be deemed assigned to the User under any circumstances.

Panacea iv owns or is the licensee of all rights over the content of the Website and the services offered through it. Accessing the Website or its services does not grant Users any right or title over the intellectual or industrial property rights in the content it hosts. The User acknowledges and accepts that its use is strictly prohibited, as is its reproduction, communication and/or distribution, modification, alteration or decompilation, whether for personal, private and non-profit purposes or for commercial or for-profit purposes.

Panacea iv reserves the right to bring the appropriate legal action against Users who violate or infringe its intellectual and industrial property rights.

User responsibility

The User is responsible for:

• Maintaining the confidentiality of any credentials provided to them, where applicable.
• Providing accurate information to Panacea iv; any error in the data provided is their sole responsibility. Likewise, the User is responsible for keeping up to date all information provided to Panacea iv, so that it reflects the User’s actual situation at all times.
• Any loss or damage that may be caused to Panacea iv or to third parties as a result of the data provided, arising from the use of data that is out of date, false or inaccurate, and from the use by third parties of the User’s personal credentials.

Availability of services

The information, content and services offered through the Website are those that Panacea iv decides at any given time and may vary over time. There is therefore no obligation to keep the services available. Nevertheless, Users will be informed if Panacea iv decides to discontinue a given service, and of the terms of that discontinuation.

Panacea iv may also cancel access to the services, in whole or in part, for Users who breach these Terms.

Warranty and liability of Panacea iv

Although Panacea iv uses systems compatible with most technologies available on the market, it cannot guarantee compatibility with the devices used by the User.

Panacea iv does not guarantee the availability or continuity of the operation of the Site or of the services offered. It is therefore exempt from any liability arising from access to and use of the Website or of the services offered through it (performance failures, interruptions or delays in the operation of the services, system or line failure, etc.), even if a failure or malfunction were to cause damage to third parties’ computer tools. In this respect, the User accesses the Website and the services entirely at their own risk.

The services offered through the Website comply with Spanish law.

Panacea iv is released from any liability in the event of improper use of the Site and/or the services by the User.

Panacea iv shall not be liable where services are unavailable due to force majeure, or temporarily suspended for technical reasons. Panacea iv therefore assumes no liability for any damage or loss suffered as a result of events that could not have been foreseen, or that were foreseen but unavoidable, whether by chance or force majeure.

Panacea iv is not responsible for any failure, technical error, accident, breakdown, tampering, service interruption or any other incident that may arise in products, equipment or technical services outside Panacea iv whose use is necessary to access the services.

Although Panacea iv has acted diligently and adopted the necessary measures, in line with the state of technology, to prevent possible security breaches of the Site, the absolute invulnerability of the security measures adopted cannot be guaranteed.

Panacea iv is not responsible for the lawfulness of third-party websites from which the Site may be accessed, nor for the lawfulness of third-party websites that may be linked from this Site.

Panacea iv will endeavour, as far as possible, to update and correct the information hosted on its website. However, any liability is excluded for damage or loss of any nature arising from a lack of truthfulness, accuracy, completeness and/or currency of the content transmitted, distributed, stored, made available, received, obtained or accessed through the Website.

As regards health-related information and content, this is provided for informational purposes only, and Panacea iv therefore recommends that the User always act under professional medical advice.

The User accepts that, should they make decisions based on the information provided on the Website, the responsibility is exclusively theirs, and no claim may be brought against Panacea iv for the consequences of those decisions.

Changes to content and terms

Panacea iv may add new functionality to the Website and/or amend the current Terms. In that case, the update will be published on the Site so that the User is aware of any change. If the User does not agree with the new terms, they have fifteen calendar days from notification to terminate the contract by giving verifiable notice to Panacea iv. If that period elapses without the User stating otherwise, this implies full acceptance of the new terms.

Jurisdiction and applicable law

This Legal Notice is governed by and construed in accordance with Spanish law. Any dispute arising from access to or use of the Website shall be submitted to the exclusive jurisdiction of the Courts and Tribunals of Madrid, without prejudice to any mandatory provision to the contrary, in which case that provision shall apply.
